What happens if the Union Legislature makes an Act against the provisions of the Indian Constitution?

The Union Legislature is also called the Parliament. It consists of the President, Rajya Sabha and Lok Sabha. To make any act, a legislation has to be passed by both the houses except in the case of Money Bills, where the consent of Lok Sabha prevails.

When the Union Legislature makes any Act against the provision of the Indian Constitution, the Judicial Review is applicable. The Judicial review is the power of Judiciary that examines the constitutionality of the laws and executive orders of both the Centre and the State.


• The judges of the Supreme Court have been given the task of upholding the constitution.


• It is they who have to ensure that the balance of power provided by the constitution is maintained by the Legislature and Executive.


• The Supreme court interferes if any Act is made against the provision of the Indian constitution.
