‘The Right to Constitutional remedy is the heart and soul of the Indian Constitution.’ Justify the statement.

Dr. B. R. Ambedkar, the Father of our Indian Constitution has called the Right to Constitutional Remedies as the heart and soul of the Indian Constitution.


1. The fundamental rights that are guaranteed by our constitution are enforceable.


2. The citizens of India have the right to seek enforcement of their fundamental rights. This right is called the Right of Constitutional Remedies.


3. The other rights become effective only because of this right.


4. When any of the rights are violated, the citizens can approach the court seeking remedies.


5. The Supreme Court or the High court of a state can be directly approached in case of violation of fundamental rights.


6. The fundamental rights are guaranteed against the actions of the Legislatures, the Executive and other authorities instituted by the Government.


7. No law can stop a citizen from seeking justice against violation of his/her fundamental right.


8. The Supreme court or the High Court have the power to issue directions or writs for the enforcement of fundamental rights.


Hence, the Right to Constitutional Remedy is the most important and powerful right that can safeguard the other fundamental rights.
