The constitution of India has granted its citizens the right to freedom of speech and expression. However, the Constitution has clearly mentioned that no person in the country can be deprived of his/her personal liberty unless and otherwise established by the law.

This enables the government or a police officer to arrest and detain any person.

The following are the procedures to arrest and detain any person as mentioned in the law:

a. A person who is arrested and detained should be informed of the reason of his arrest.

b. The arrested and detained person should be produced before the nearest court of magistrate within 24 hours of his arrest.

c. The arrested person is permitted to consult his lawyer or engage a lawyer in his defence.

Any breach of right or liberty is punishable under law.
